It is in the nature of our daily work that in order to be able to provide legal services to our clients, and to administer our business, we  store certain personal information.  We are required by the Protection of Personal Information Act (POPIA) to inform you about the information we collect and how we store it.

By providing us with your personal information, you agree to this Policy and authorise us to store and process such information.

Information we collect

We collect information received from you, whether on request, through application forms completed, e-mail requests or by phone.

 We collect the following information about you:

1.     your name, address, contact details, date of birth, place of birth, identity number, copy of your ID document or passport

2.     if you have a company: company name, legal entities’ registration numbers, directors, shareholders, members, trustees, beneficiaries

3.     any other information needed in order to give you advice on your matter

4.     your client files and records

5.     correspondence conducted with you and on your behalf

How we look after your information

The information that we collect and store relating to you is primarily used to enable us to provide our services to you.

 All information is treated as strictly confidential.

Generally accepted standards of technology and operational security have been implemented in our firm to protect information from loss, misuse, alteration, or destruction, and unauthorized access.

 As part of our internal processes and procedures, we review our security measures on an ongoing basis to  ensure personal information remains secure. Our staff receive regular information on information security.  

Information sharing or transfer to third parties in South Africa and/or across borders:

In general, we do not share your personal information with third parties (other than service providers acting on our behalf) unless we have a lawful basis for doing so. Where information is shared across borders, it will only be done where necessary to fulfill a mandate and to countries that have similar or better safeguards, security, and protection in place for personal information.

We collect the following company information:

•       Audited financial statements

•        Tax and levy records

•        Investment accounts

•        Management accounts

•        Contracts with suppliers

•        Trust and business account information

•        Fidelity fund certificates

•        Budgets

•        Correspondence, e-mails, backups

•        Bank statements

•        Staff records

 Disclosing Your Information

We may disclose your personal information to third parties:

1.Where we are legally required to disclose your information.

2. To assist fraud protection and minimise credit risk.

Your rights as a client

 

Under POPIA you have the right:-

·      to be fully informed about what data we collect, why we collect it and whether we intend to transfer it;

·      to deletion or destruction of information (as prescribed by laws and regulations);

·      to notification of a data breach/security compromise;

·      to object to processing of personal information for certain purposes;

·      to have information transferred to a third party on request by you;

·      to lodge a complaint with the Regulator at https://www.justice.gov.za/inforeg/ or complaints.IR@justice.gov.za
