WHAT NATIONAL WILLS WEEK IS

The National Wills Week is an initiative to increase awareness for the importance of having a valid Will, and affords South African law firms the opportunity to give back to South African society by providing free basic wills.

WHY YOU SHOULD HAVE A WILL

The pandemic has reminded us all of our mortality. As unpleasant as it may be, it is important to consider what will happen to our loved ones and our property after we die.

If you do not leave behind a valid Will your property will be divided according to the Intestate Succession Act[1] - which means that you will not have a say in what happens to your assets when you die.

A Will affords you the opportunity to ensure that your loved ones are looked after in the best way possible after your death.  

A well-drafted Will can also help prevent disputes between your loved ones over the property that you leave behind.

WHY YOU SHOULD UPDATE YOUR WILL

Not only is it important to have a Will, but you must also ensure that your Will keeps up-to-date with the changes in your life. For example, if you get married or have children your Will must be updated in order for these new family members to benefit from your estate.

Similarly, if you buy a new asset, such as a house – you need to update your will so that your asset is dealt with properly when you die.

  • A list of everything you own (including personal items that you wish to leave to specific people);

  • The approximate value of each item you own; and

  • A list of the people you wish to remember in your will.
