Question 1: How old should you be before creating a Will?

QUESTION 2: If you die without a Will, what will happen to your property?

A)  Your property will be donated to the State.

B)  Your spouse will inherit everything according the Marriage Act of 1961.

C)  Your estate will devolve according to the Intestate Succession Act, 1987 (Act 81 of 1987). This means that your estate will be divided amongst your surviving spouse, children, parents or siblings according to a set formula.


QUESTION 3: Can I draw up my own Will without seeking professional advice and if I do so will my Will be valid?

A)   No, a Will is only valid if drafted by an Attorney.

B)    Yes, a Will can be drafted by a lay person and be valid as long as it complies with all formalities required by law*. - See the requirements for a Will below.

C)  A Will drafted by a lay person must be approved by the High Court to be valid.


QUESTION 4: Can you have a joint Will with someone else?

A)  A joint Will must provide for a bequest of the estate of the first dying of the parties, a bequest of the estates of both parties if they die within a short period of one another and a bequest of the survivor’s estate should they survive the first dying and thereafter die without making a further will. Provided these requirements are met a joint will is valid.

B)  No, you cannot have a joint Will. Your will can only deal with your estate not someone else’s.

C) Yes, but only if you are married.


QUESTION 5: If you have assets in a foreign country, may you have a separate Will in respect of those assets or can you have one Will to cover your worldwide estate?

A) No, you must have a Will specifically for each country you hold property in. 

B)  It is recommended that a person has a separate Will drafted by an expert in the relevant law of each country where they have assets because succession law and the procedures which have to be followed with regard to estate administration differ from country to country.

C) Yes, you must have only one single Will, which is sufficient for all property regardless of where it is held.


QUESTION 6: If you want to bequeath your immovable property to your children but also wish your spouse to be able to live in this property until their death, is it possible to provide for this in your will?

A)  No, you have to choose to bequeath your immovable property to specific family members. 

B)  Yes, but your spouse would need to pay a portion of the purchase price of the house to the children in equal shares.

C)  Yes, this is possible. The bequest to your spouse would be of what is legally known as a limited interest (such as a usufruct). The title deed in respect of the immovable property would contain a reference to the limited interest so that your children would not be able to dispose of the property without your spouse’s consent. 


QUESTION 7: What is a testamentary trust?

A)  A testamentary trust is a trust created by a person while they are still alive.

B)  A testamentary trust is a trust that is established in accordance with the instructions contained in a last will and testament. A trust is a fiduciary relationship that allows a trustee, who is a third party, to manage assets on behalf of the beneficiaries of the trust.

 C)  A testamentary trust is a trust created for donation purposes only.

 QUESTION 9: What is a Living Will?

A)  A document which you sign to the effect that you do not wish to be kept alive by artificial means or by the use of life prolonging drugs in the event that your state of health is such that there is no reasonable hope of your recovery and the condition from which you are suffering is causing you severe pain and distress or making you too incapable of rational life.

B)  A document setting out how your business affairs are managed after your date of death.

C)  An addition or supplement to a Will that explains, modifies, or revokes a will or part of one.


QUESTION 10: Is an electronic Will valid in South Africa?

A) No, a Will must always be written/printed on hard copy for it to be valid.

B) A court can in certain circumstances order that an electronic Will be accepted by the Master although it does not comply with all the formalities for the execution or amendment of wills but only in strict circumstances.

C) Yes, an electronic Will is always a valid form for a Will.

* Requirements for a Will

The testator must be 16 years or older and have the mental capacity to understand the consequences of their actions at the time that the Will is drafted.

  1. The Will must be in writing. It can be handwritten or printed and should be as clear to read as possible.

  2. The Will must be signed by the Testator in full just below or as near as possible to the last line of the document.

  3. The Will must be signed by the Testator in the presence of two competent witnesses who must be in the presence of each other and in the presence of the Testator at the time the Will is signed.

  4. A competent witness is anybody over the age of 14 who is of sound mind and who has the ability to testify in court.

  5. The witnesses must sign the last page of the Will together with the Testator, as near as possible to the end of the document. If the Will is more than one page long, the Testator must sign every other page of the Will, as well as the last page. It is recommended that the witnesses also sign every other page of the Will in addition to the last page, although this is not a requirement in law.
